1494 Upper Wellington OLT Hearing Shortened as Some Minor Issues Resolved – TPR Hamilton


The Ontario Land Tribunal (OLT) has significantly reduced the length of the upcoming contested hearing for the proposed redevelopment at 1494 Upper Wellington Street. In a procedural order issued on March 5, 2026, the Tribunal announced that the hearing, originally scheduled to begin on April 13, will now start two weeks later on April 27, 2026.

The hearing is still scheduled to conclude on May 8, 2026. This reduction in time, from 20 days down to 10, comes as the number of outstanding issues between the developer, Valery Group, and the City of Hamilton has decreased.

The matter involves a non-decision appeal regarding Valery Group’s proposal to construct two 20-storey towers atop a four-storey podium at 1494 Upper Wellington Street. The project, which originally proposed 685 rental units, has been the subject of ongoing negotiations between the developer and City planning staff.

While the parties originally identified 37 areas of disagreement, the recent narrowing of these issues suggests that mediation or continued discussions have successfully resolved some of the technical or planning concerns.

Valery Group and the City of Hamilton are expected to focus the ten days of arguments on issues the height and density of the proposed rental buildings.
